Terms & Conditions

Article 1. General

​By booking a tour, you acknowledge that you have read, understood, and agree to abide by these Terms. These Terms, together with our Privacy Policy and any other written information provided prior to your booking confirmation, form the contract between you and us. If you are booking on behalf of other participants, you confirm that you have the authority to accept these Terms on their behalf. You consent to the Tour Operator's use of your Personal Data in accordance with our Privacy Policy and authorize the disclosure of personal information for all participants, including any special categories of data such as health conditions, disabilities, or dietary requirements.

1.1 Definitions

  1. "We", "us", "our": Refers to STX Travel (Company Registration Number 94430292), a travel organization based in Velp (NB), The Netherlands. For inquiries, you can contact us via email at info@stx-travel.com.

  2. "STX Travel": The registered name of the company that operates the Tours, which is responsible for all aspects of the travel experience, including bookings, customer service, and adherence to these Terms and applicable laws.

  3. "You", "your": Refers to the person, organization, or entity using our Website or participating in a Tour with us.

  4. "Customer": An individual or legal entity that enters into an agreement with STX Travel.

  5. "Consumer": A Customer acting in a private capacity.

  6. "Parties": STX Travel and the Customer together.

  7. "Tour": The travel experience organized by the Tour Operator, which includes a specified itinerary, accommodations, and activities. The Tour(s) described on our Website or any Tour we have agreed to provide to you.

  8. "Tour Operator": The entity that organizes and sells the Tours, responsible for the arrangement and provision of travel services and experiences as described in the Tour itinerary, including accommodations, transportation, activities, and customer service during the Tour.

  9. "Terms": These Terms & Conditions, together with any amendments made. Customers will be notified of any significant changes to these Terms.

  10. "Claim" or "Claims": Includes any claim, notice, demand, right, entitlement, action, proceeding, litigation, or other legal matters.

  11. "Website" or “Site”: Our website, https://www.stx-travel.com/, which may be supplemented or varied from time to time. Users are responsible for their use of the website.

  12. "Fee", "Fees", "Price", "Prices": The fee set by us for the Tour, as specified on the Site.

  13. "Third party": Anyone not part of STX Travel, including but not limited to suppliers and partners.

  14. "Waiver": The participation waiver form that you are required to sign upon arrival, which outlines the risks associated with the Tour and confirms your assumption of responsibility for those risks.

  15. "Law" or "Laws": Relevant laws, regulations, and any approvals or licenses from relevant authorities.

  16. "Cancellation Policy": The policy that outlines the terms and conditions related to the cancellation of a Tour by the Customer, including any applicable fees.

  17. "Force Majeure": Refers to unavoidable or extraordinary events beyond the control of the Tour Operator that make it impossible to travel safely or remain at the destination. Examples include natural disasters, extreme weather conditions, acts of war, terrorism, or political unrest.

  18. "Personal Data": Any information that relates to an identified or identifiable individual, as defined by relevant data protection laws, including the General Data Protection Regulation (GDPR).

  19. "Host": Refers to an individual, typically a social media influencer or public figure, who invites their followers to join a Tour. The Host is always present during the Tour and provides activities such as workouts and workshops. In some cases, the Host also acts as the Group Leader. In other instances, the Host is accompanied by an STX-appointed Group Leader who manages the logistics and ensures smooth operations

  20. "Group Leader": Refers to the individual designated by STX Travel to oversee and facilitate the Tour for participants. The Group Leader ensures that all arrangements run smoothly, addresses any logistical issues, and serves as the primary point of contact for participants, STX Travel, and local tour operators.

1.2 Governing Law & Jurisdiction

  1.2.1 Applicable Law

  • These Terms and Conditions, and any agreement to which they apply, shall be governed by and construed in accordance with the laws of the Netherlands. This applies to all Customers, regardless of their country of residence or nationality.

  1.2.2 Jurisdiction

  • Any disputes arising out of or in connection with these Terms or the services provided by the Tour Operator shall be submitted to the exclusive jurisdiction of the competent courts in the Netherlands.

  1.2.3 Website Compliance

  • Our Website may be accessed from anywhere in the world, and we make no representation that the Site complies with the laws of any country outside the Netherlands.

 

1.3 Limitation of Liability

  • To the maximum extent permitted by law, our total liability arising out of or in connection with these Terms, regardless of the cause, is limited to either resupplying the relevant Tour to you or paying you an amount not exceeding the Fees you have paid to us.

  • During or after our Tour, you may have the opportunity to participate in optional activities operated by Third Parties and not included in the price of your trip. You are responsible for all risks associated with transportation to or from, and your participation in, or visit to, any place, activity, or excursion not listed as included in the Tour.

  • Any assistance we provide in arranging, selecting, or booking optional activities is done at your request, and we make no warranties and expressly disclaim any liability arising from participation in optional activities. You acknowledge and agree that any liability for loss, damage, death, personal injury, illness, emotional distress, mental suffering, or psychological injury, or loss or damage to property associated with any optional activities you choose to participate in is the sole responsibility of the Third Party providing that service or activity.

  • We shall not be held liable for any damage to or loss of property or injury to or death of persons caused, directly or indirectly, by an act or omission of any other provider, including but not limited to any defects in any aircraft, watercraft, or vehicle operated or provided by such other provider. We are also not liable for any losses or damages due to delays, cancellations, or disruptions in any way caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other causes beyond our control. You waive any claim against us for such loss, damage, injury, or death.

  • In the event that any loss, death, injury, or illness is caused by the negligent acts or omissions of us or of the Third Party suppliers of any services that form part of the booking contract, then we limit our liability, where applicable, according to all applicable international conventions.

 

1.5 Images, Videos, Reviews & Marketing

  • Throughout the Tour, your Tour Guide, local guides, or fellow participants may capture photographs or record videos of you engaging in Tour activities. You may also choose to share your own photos or videos with us. By participating in the Tour, you grant us permission to use these images and videos for marketing purposes. This includes displaying your photographs or videos, along with your name, on our Website and across our social media platforms. If you prefer that your images or videos not be used in this way, please let us know before the Tour commences.

Article 2. BOOKING REQUIREMENTS

2.1 Confirmation of Your Booking

  • Your booking is considered confirmed when the Tour Operator or its agent issues a written confirmation upon receiving the deposit amount. Please review your confirmation carefully for accuracy and report any discrepancies immediately. Ensure that the names match exactly with those on your passport.

  • You must be at least 18 years old to make a booking. If you are under 18, you must have consent from a parent or guardian. Please ensure that you provide accurate and complete information.

2.2 Booking on Behalf of Others

  • When you book on behalf of other participants, you are considered the designated contact person for all individuals included in that booking. This means you are responsible for making all payments related to your Tour booking, notifying the Tour Operator or your travel agent of any required changes or cancellations, and keeping your party informed.

  • By booking on behalf of another individual or individuals, you represent and warrant that you have obtained all necessary consents. You are responsible for ensuring that any information you provide on behalf of another participant is complete and accurate. The Tour Operator shall not be liable for any errors or omissions in the information provided to complete the booking.

2.3 Your Details

  • We require personal information, including your full name (as per passport), date of birth, gender, email address, and any special medical or dietary requirements. If the tour includes a flight, you must also provide your passport number. Please ensure that all information provided is accurate and up to date, as inaccuracies may affect your booking and travel experience.

2.4 Health and Medical Conditions

  • Your safety and health are our top priorities during our tours. Therefore, you should not participate in a tour if it may negatively impact your physical or mental well-being. If you are unsure about your ability to safely join a tour, we strongly recommend seeking medical advice before booking.

  • It is your responsibility to inform us of any physical or mental health issues, including pre-existing conditions, that may affect your ability to safely participate in a tour. In some cases, we may require you to complete a medical clearance form, which we will provide, signed by a licensed medical practitioner.

  • You agree to provide all relevant medical information accurately and fully. We will handle this information in strict accordance with our Privacy Policy, ensuring your personal data is protected.

  • Pregnancy is considered a medical condition and must be reported to the tour operator when booking. For safety reasons, the tour operator may refuse to transport women who are more than 24 weeks pregnant. However, this is only done based on medical and safety grounds, which are clearly explained to the traveller. If the tour operator is unable to make reasonable adjustments for certain medical conditions, we may unfortunately have to refuse participation.

  • You are responsible for assessing whether a Tour is suitable for you based on your health status and any medical conditions. We strongly advise you to consult your physician to confirm your fitness for travel and participation in any planned activities.

  • Travel with the Tour Operator may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies, and the Tour Operator makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.

 

2.5 Special Requirements

  • You must notify us of any special requirements at the time of booking. While we will do our best to accommodate these needs, it may not always be feasible due to the nature of the destinations or limited alternatives outside the planned itinerary. If you have limited mobility, some activities may not be accessible. Additionally, you are required to disclose any food allergies or dietary restrictions at the time of booking.

  • While we will relay this information to the Tour Operator, we cannot guarantee that all dietary needs can be accommodated, as this may depend on the specific locations and available resources. Special requests and requirements are not considered part of these Terms or the contract, and the Tour Operator is not liable if they cannot be fulfilled, especially if not communicated at the time of booking.

2.6 Passport and Visa Requirements

  • You are required to possess a valid passport for the entire duration of your tour, which must remain valid for at least six months beyond the conclusion of the tour. A valid passport must have at least two blank pages and should not contain any torn pages. It is your responsibility to ensure you have the necessary visas for the countries you will be visiting during the tour.

  • STX Travel will not be held liable for any issues arising from denied entry to any country due to an invalid passport, missing visa, or any other required travel documents.

2.7 Acceptance of the Travel Agreement

  • By booking a Tour with STX Travel, the traveler agrees to the travel agreement and the associated terms and conditions. The travel agreement contains essential information regarding the Tour, including the itinerary, included and excluded services, payment terms, modification and cancellation policies, liability, and insurance requirements.

  • At the time of booking, the traveler must confirm that they have read, understood, and accepted the travel agreement and terms and conditions. STX Travel is not responsible for any consequences arising from failure to review these documents. Any disputes will be resolved according to the applicable law as stated in the terms and conditions.

Article 3. PARTICIPATION REQUIREMENTS

3.1 Mandatory Insurance Requirements

  • You must have travel insurance with a minimum coverage of €200,000 (or the equivalent in USD) for medical expenses, evacuation, and repatriation, covering all applicable dates of travel with the Tour Operator. This insurance must include coverage for personal injury and emergency medical expenses.

  • Proof of valid travel insurance must be presented upon arrival. Failure to provide proof may result in denial of participation in the tour, without the right to a refund.

  • It is strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise due to loss, damage, injury, delay, or inconvenience while traveling, particularly for trips to remote areas or those involving adventure activities.

  • You acknowledge that insurance coverage is not included in the cost of any Tour offered by the Tour Operator, which is a common industry practice, and you are required to obtain separate coverage at your own expense. It is your responsibility to ensure you have sufficient coverage and comply with the terms of the applicable insurance plans.

  • You should read your policy carefully to understand any exclusions or limitations. Additionally, you are responsible for informing your insurer about the type of travel, destinations, and activities included in your booking, as failure to do so may result in denied claims.

 

Article 3.2: Acceptance of Risk / Participation Waiver

  • Your participation in the Tour is at your own risk, and you agree to sign a waiver form upon arrival before the tour begins. If you refuse to sign this waiver, you cannot participate in the tour and will not be eligible for a refund or compensation. However, this waiver does not exclude the Tour Operator's liability for gross negligence or willful misconduct.

  • You understand that the Tour may involve adventurous activities and personal risks, including visiting locations with political, cultural, or geographical conditions that present greater dangers and challenges than those in your everyday life. We base our decisions regarding safety on information from government foreign departments and reports from our contacts. It is your responsibility to familiarize yourself with all relevant travel information, including health risks and itinerary specifics, which the Tour Operator will provide to the best of their ability. By choosing to travel, you acknowledge that you have considered this information and accept the personal risks involved. To the maximum extent permitted by law, we disclaim any liability for these additional risks.

  • You acknowledge that adventure travel and the products and services offered by the Tour Operator may involve significant risks to your health and safety. By traveling with the Tour Operator, you confirm that you have considered these potential risks and that you are advised to take into account your personal limits and capabilities before participating. You assume full responsibility for all such risks and release the Tour Operator from any claims or causes of action arising from losses, damages, injuries, or death resulting from inherent travel risks, including those specific to adventure travel, visiting foreign destinations, and participating in activities featured in the tour itineraries or otherwise provided by the Tour Operator. You are required to confirm this assumption of responsibility by signing the participation Waiver upon your arrival.

  • You acknowledge that the level and type of personal risk may vary depending on the products or services booked and the locations where they take place. There may be a considerable degree of personal risk, particularly when engaging in physical activities, traveling to remote areas, utilizing watercraft, participating in extreme sports, or other high-risk activities, or visiting countries with developing infrastructure. Standards of hygiene, accommodation, and transport in some countries where Tours operate may be lower than what you might reasonably expect in your home country.

  • You agree that the Tour Operator is not responsible for providing information or guidance regarding local customs, weather conditions, specific safety issues, physical challenges, or applicable laws in the locations where a Tour, product, or service is conducted. You must comply with all applicable laws, regulations, and local customs of the countries and regions visited at all times. If you fail to comply, engage in illegal acts while on Tour, or, in the opinion of the Tour Operator (acting reasonably), your behavior causes or is likely to cause danger, distress, or significant annoyance to others, the Tour Operator may terminate your travel arrangements immediately, at your expense, and without liability. In such cases, you will not be entitled to any refund for unused or missed services, or any costs incurred due to the termination of your travel arrangements, including but not limited to return travel, accommodations, meals, and incidentals.

  • You are responsible for any costs (including repair, replacement, and cleaning fees) incurred by the Tour Operator or its suppliers due to property damage, destruction, or theft caused by you while on Tour. You agree to report any pre-existing damage immediately to a representative of the Tour Operator and the staff of the accommodation, transportation service, or facility as soon as it is discovered.

  • You agree to take all necessary precautions regarding your safety while on Tour, including but not limited to the proper use of safety equipment (such as seatbelts, harnesses, flotation devices, and helmets) and following all posted signs and verbal or written warnings regarding health and safety. Neither the Tour Operator nor its Third Party Suppliers (as defined herein) are liable for any losses or damages resulting from your failure to comply with safety instructions or warnings.

  • You agree to raise any complaints with the Tour Operator as soon as possible during the Tour, allowing the Tour Operator the opportunity to address your concerns. Complaints should be reported directly to your tour leader, another representative of the Tour Operator, or the Tour Operator's customer service department. The Tour Operator assumes no liability for complaints not properly reported and cannot resolve or attempt to resolve complaints without proper notice. If you fail to notify the Tour Operator of your complaints or concerns during the Tour, the Tour Operator will have been deprived of the opportunity to investigate and resolve the issue promptly, which may affect your rights under these Terms. Any complaints made after the completion of the Tour must be submitted in writing to the Tour Operator within 30 days of the last day of travel for the booking in question.

 

3.2.1 Signing the Waiver

  • Upon arrival for the tour, participants are required to sign the participation waiver. This waiver confirms that the participant understands and accepts the risks associated with participating in the tour. The waiver will be available on-site for signing, and participation in the tour is only permitted after it has been signed. Participants should be aware that signing the waiver is a condition for their participation in the tour.

3.3 Conduct Conditions

  • During the tour, you must cooperate with your tour guide and behave in a respectful, lawful, non-aggressive, non-bullying, and appropriate manner. You are expected to adhere to these Terms and follow any instructions or directions provided by us or our tour guides at all times. In the event of a breach of conduct, we reserve the right to issue you a written warning detailing the inappropriate behavior and its consequences. If necessary, we may remove you from the tour. If you are removed, you will not be eligible for a refund or compensation. You acknowledge and agree that we cannot control the behavior of you, other group members, or third parties, and we will not be held responsible for any actions taken by you, other group members, or third parties. Additionally, you agree to indemnify the Tour Operator for any damages or claims arising from your inappropriate conduct.

 

3.4 Prohibition of Illegal Substances

  • The use, possession, or distribution of illegal drugs or substances during the tour is strictly prohibited. Any participant found in violation of this policy will be subject to immediate removal from the tour without refund or compensation. We reserve the right to report any illegal activities to the appropriate authorities.

 

3.5 Compliance with Laws

  • You must comply with all applicable laws and regulations of the countries and regions visited at all times. If you fail to comply, engage in illegal acts while on tour, or, in the opinion of the Tour Operator (acting reasonably), your behavior causes or is likely to cause danger, distress, or significant annoyance to others, the Tour Operator may terminate your travel arrangements immediately, at your expense, and without liability. In such cases, you will not be entitled to any refund for unused or missed services, or any costs incurred due to the termination of your travel arrangements, including, but not limited to, return travel, accommodations, meals, and incidentals.

3.6 Issues on Tour

  • If you are dissatisfied with any aspect of the service during the tour, please address your concerns with your group leader as soon as possible to give them an opportunity to resolve the issue. If discussing the matter with your group leader is not suitable or if the leader is part of the problem, please email [insert contact email] without delay. We will strive to address the situation fairly and promptly. Please note that if we are not contacted within 48 hours of the issue arising, or if we are not given the chance to address the issue at the time it occurs, we cannot be held responsible for any compensation related to the issue. However, you may still file a written complaint within 30 days of the completion of your tour.

  • If medical attention is necessary for you while on tour—whether for a physical injury, illness, or mental health issue—we cannot be held liable for any associated costs. It is your responsibility to secure adequate travel insurance that covers medical expenses, evacuation, and repatriation, as we cannot be held liable for any medical costs you may incur while on tour. We will provide information on local medical facilities and services to the best of our ability.

  • You are required to provide us with an emergency contact. By providing this contact, you give us explicit permission to reach out to this person in case of an emergency related to your health, safety, or well-being during the tour, in compliance with privacy regulations (GDPR). Should we determine that your physical or mental health, or the safety of other group members or the public, is at risk due to your behavior, you agree that we may contact your emergency contact if we deem it necessary.

3.7 Liability for Accidents, Illness, Theft, and Personal Property

  • We are not liable for any accidents, illnesses, theft, or damage to or loss of personal belongings that may occur during the tour, unless these are a result of our negligence or that of our agents or suppliers. This includes, but is not limited to, any physical injuries or health issues, theft of personal items, or damage to or loss of personal property.

  • You are required to ensure you have adequate insurance coverage to protect against such risks. However, if it can be demonstrated that the Tour Operator or its representatives were at fault or failed to meet the standard of care required, we may be liable in accordance with applicable Dutch or European law.

  • In cases where we or our agents act negligently, resulting in personal injury or other harm, we will comply with the legal obligations under Dutch and European law to provide appropriate compensation or redress. Our liability for such incidents will not exceed the total cost of your booking.

  • We are not responsible for any claims or costs arising from incidents that were beyond our control or not attributable to our actions, such as force majeure events, unless otherwise specified under applicable law.

  • Participants are responsible for their personal belongings during the tour. The Tour Operator is not liable for theft, loss, or damage to personal belongings of participants that may occur during the tour, regardless of the circumstances, including theft committed by other participants in the group.

  • Participants are encouraged to keep a close watch on and protect all valuable items, such as money, electronics, and personal documents. In the event of theft or damage to personal belongings, it is the participant's responsibility to report this immediately to the Tour Operator and, if possible, to local authorities.

3.8 Safety Compliance and Participant Responsibility

3.8.1 Compliance with Safety Regulations

  • Participants are required to follow all safety instructions and regulations provided by the Tour Operator, guides, and relevant authorities during the trip. These measures are in place to minimize risks and ensure the safety of all participants. Failure to do so may result in exclusion from activities or the tour, as outlined in 3.8.3.

3.8.2 Liability for Non-Compliance

  • If a participant fails to adhere to the prescribed safety regulations, the Tour Operator is not liable for any resulting accidents, injuries, or damages, except in cases of gross negligence or willful misconduct by the Tour Operator.

  • Any costs arising from non-compliance, including but not limited to medical expenses, evacuation, or additional accommodation and transport, will be at the participant’s own expense.

3.8.3 Dismissal from the Tour

  • The Tour Operator reserves the right to exclude any participant from further participation in the tour or specific activities if their actions pose a risk to themselves or others due to non-compliance with safety regulations. In such cases, no refunds will be provided.

Article 4. Prices

4.1 Pricing

  • The prices for the Tours are listed exclusive of VAT unless explicitly stated otherwise. Certain services we offer may be exempt from VAT under Dutch and EU regulations. For more information on VAT applicability to your specific booking or if you have any inquiries regarding taxes, please contact us directly.

4.2 Price Changes

  • STX Travel reserves the right to adjust the prices of the Tours in the event of unforeseen circumstances that lead to an increase in operational costs (e.g., transportation costs, currency fluctuations, or government-imposed fees). If such price increases exceed 8% of the total travel price, you have the right to cancel your booking and receive a full refund unless the price increase is due to legal or regulatory requirements. Any changes will be communicated to you promptly, and you will be given a reasonable timeframe (at least 14 days) to accept the new price or cancel the agreement.

Article 5. Booking

5.1 Making a Booking

  • You can make a booking online, in person, or via authorized agents. It is your responsibility to ensure that all information provided during the booking process is accurate. After completing your booking, you will receive a Confirmation Email. You are responsible for reviewing the booking details carefully, including the tour information, start date, and the spelling of your name. Should any errors be found, you must notify us within 24 hours to correct them without incurring additional fees.

 

5.2 Arrival Information and Airport Pick-Up

  • All customers must provide their arrival details, including arrival date, time, and flight number, at least 3 days prior to their arrival. Failure to submit this information within the specified timeframe may result in the unavailability of the included airport pick-up service, and we cannot be held liable for any additional costs.

  • If the airport pick-up cannot be arranged due to the late submission of arrival information, customers will be responsible for arranging and covering the cost of their own transportation to the first accommodation. We cannot be held responsible for any additional expenses incurred, including possible inflated fares or fraud-related incidents. In such cases, no refund will be issued for the unused airport pick-up service included in the total booking price.

5.3 Changes to Booking

  5.3.1 Changes by the Customer:

  • If you wish to make changes to your booking, such as altering the travel dates or transferring your booking to another person, you must notify us as soon as possible. All requests for changes are subject to availability and additional charges may apply. The earlier you make the request, the more likely it is that we can accommodate the changes. If changes are requested within 30 days of the tour start date, we may be unable to accommodate your request, and standard cancellation fees may apply.

 

  5.3.2 Changes by the Tour Operator:​

  • We reserve the right to make minor changes to your itinerary. These changes may include, but are not limited to, adjustments in accommodation or transportation due to availability. We will inform you of any significant changes as soon as possible. If we are forced to make major changes to your booking (such as a significant change to the itinerary, a change of destination, or substantial changes to the travel dates), you will have the right to: 

  1. Accept the proposed change.

  2. Book an alternative tour of equal or higher value, subject to availability.

  3. Cancel your booking and receive a full refund of any payments made, without incurring cancellation fees.

  5.3.3 Fees for Changes:

  • If you request changes to your booking, administrative fees may be applied. These fees are necessary to cover the costs of processing and managing your request. If applicable, these fees will be communicated to you before we make any changes

Article 6. Payments

6.1 Deposit / Full Payment

  • To secure your booking, a deposit of €300 is required. If you book within 30 days before the start date of the Tour, you must pay the full amount at the time of booking. After payment, your booking will be confirmed. Do not book non-refundable flights or make other travel arrangements until you have received this confirmation.

6.2 Final Payment

  • The remaining balance of the total Tour price must be paid no later than 30 days before the start date of your Tour. Failure to make this payment may result in the cancellation of your booking, and any deposits paid will be forfeited.

6.3 Payment Methods

  • We accept various payment methods, including credit cards, bank transfers, and online payment platforms. All payment details will be provided upon booking. Any fees associated with certain payment methods (e.g., international transfers) are the responsibility of the Customer.

 

6.4 Late Payments

  • If the final payment is not received by the specified deadline, we reserve the right to cancel the booking. In such cases, you may lose any deposits already paid, and cancellation fees may apply.

6.5 Additional Fees

  • Any additional fees arising from the method of payment (such as international transfer fees, currency conversion costs, or credit card fees) are your responsibility. These fees will not be included in the Tour price and must be paid separately.

Article 7. Airfare

7.1 Airfare Not Included

  • Tour prices do not include international flights or any other airfare unless explicitly stated in the Tour descriptions. It is your responsibility to arrange and pay for your own flights. We recommend verifying all flight details and ensuring your flight schedule aligns with the tour itinerary to avoid any conflicts.

7.2 Responsibility for Changes

  • We are not liable for any costs incurred due to flight delays, cancellations, or any other changes related to your airfare. Please ensure that you have appropriate travel insurance to cover any potential costs arising from changes to your travel arrangements.

Article 8. Flexibility & Unused Services

8.1 Flexibility to Itineraries

  • You acknowledge that the nature of adventure travel requires flexibility and agree to permit reasonable alterations to products, services, or itineraries by the Tour Operator. The route, schedules, accommodations, activities, amenities, and modes of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of the Tour Operator. Such events may include, but are not limited to, Force Majeure (e.g., natural disasters, extreme weather conditions), illness, mechanical breakdowns, flight cancellations, strikes, political events, and entry or border difficulties.

  • The Tour Operator will make reasonable efforts to inform you of significant changes to the itinerary as soon as possible.

  • No reimbursements, discounts, or refunds will be issued for services that are missed or unused after departure due to circumstances beyond the control of the Tour Operator, including your removal from a Tour because of your negligence or breach of these Terms.

Article 9: Cancellation Policy

9.1 Booking Confirmation

  • A booking is considered final once the deposit has been received.

  • The deposit of €300 is strictly non-refundable, regardless of when the booking is made.

 

9.2 Cancellation Fees

  • Cancellation is possible, but fees apply as outlined below. These conditions are also stated in the booking confirmation or on the STX Travel website.

  • If a cancelled spot is resold, STX Travel may decide to (partially) refund cancellation fees, but this is not guaranteed.

 

9.3 Cancellation Fees Schedule

  • If you cancel your booking, the following fees apply:

    • At any time after booking: Deposit (€300) is non-refundable.

    • More than 4 months (120+ days) before departure: No additional costs (only deposit is lost).

    • 3 to 4 months (90–120 days) before departure: 50% of the total travel sum.

    • Less than 3 months (0–90 days) before departure: 100% of the total travel sum.

 

9.4 No-Show or Early Departure

  • If you do not show up for the tour or decide to leave early, no refunds will be given.

 

9.5 Payment Terms

  • A deposit of €300 is required at the time of booking.

  • The remaining travel sum must be paid no later than 90 days before departure.

  • If full payment is not received by the deadline, STX Travel reserves the right to cancel the booking without refunding the deposit.

 

9.6 Transfer of Booking

  • You may transfer your booking to another person up to 7 days before departure, provided you notify STX Travel in writing.

  • The original traveller remains liable for any outstanding payments and an administrative transfer fee of €50.

 

9.7 Exceptional Circumstances

  • If unavoidable and extraordinary circumstances (e.g., serious illness or injury) require you to cancel, the above cancellation terms still apply. You may be able to claim costs through your travel insurance.

 

9.8 Force Majeure

  • If a Force Majeure event occurs, cancellation fees may be waived if the trip cannot proceed as planned due to unavoidable circumstances.

Article 10. Force Majeure

10.1 Definition

  • Force Majeure refers to unavoidable and extraordinary circumstances beyond the Tour Operator's control that make it impossible to travel safely to or stay at the tour destination. Examples include illness or unexpected unavailability of the host, natural disasters, extreme weather conditions, acts of war, terrorism, political unrest, epidemics, and government-imposed travel restrictions.

10.2 Liability for Force Majeure

  • If the Tour Operator is forced to cancel or significantly alter a tour due to Force Majeure, the Tour Operator is not liable for refunds or compensation. However, cancellation fees outlined in Article 8 may be waived if the situation qualifies as Force Majeure.

10.2.1 Cancellation Due to Host Unavailability

  • If the host is unable to lead the tour due to Force Majeure, the Tour Operator will make reasonable efforts to find a suitable replacement. If no replacement is available, the Tour Operator reserves the right to cancel the tour.

  • In case of cancellation due to the unavailability of the host, participants will be informed as soon as possible.

10.2.2 Compensation and Liability

  • In case of cancellation due to Force Majeure, participants are not entitled to compensation for costs already incurred, such as flights or personal expenses.

  • The Tour Operator is not liable for any damages resulting from cancellations due to Force Majeure, except in cases of intentional misconduct or gross negligence.

  • Participants are advised to take out travel and cancellation insurance to protect themselves against unforeseen expenses.

10.3 Rebooking

  • If a tour is cancelled or significantly altered due to Force Majeure, participants are entitled to rebook to a different date or a tour of equivalent value at no additional cost. If no suitable alternative is available, a refund may be requested for amounts paid, minus applicable fees as stipulated in Article 8.

10.4 Termination Due to Force Majeure

  • If a Force Majeure situation persists for 30 days, either party may terminate the agreement in writing without compensation. However, termination does not negate the participant's right to refunds or alternative arrangements as stated in this policy.

Article 11. Changes to Terms and Conditions

11.1 Right to Change

  • STX Travel reserves the right to modify these general terms and conditions at any time. Any changes will be effective immediately upon posting the revised terms on the STX Travel website.

11.2 Minor Changes

  • Minor changes to the terms and conditions can be made without prior consultation with the Customer. Such changes may include clarifications or adjustments that do not materially affect the rights or obligations of the parties.

11.3 Significant Changes

  • Significant changes to these terms and conditions, which may affect the Customer's rights or obligations, will be communicated to the Customer in advance. If the Customer does not agree to the changes, they have the right to cancel the agreement without incurring cancellation fees. In such cases, the Customer must notify STX Travel of their intent to cancel within 7 days of receiving the notification of changes.

11.4 Effectiveness of Changes

  • Continued use of STX Travel's services after the posting of changes constitutes acceptance of those changes. It is the Customer's responsibility to regularly review the terms and conditions to stay informed of any updates.
